Rule 1 – General Rules
Article (1)
In the application of the provisions of this Law, the subsequent terms shall mean:
1- Ministry: The Ministry of Social Affairs and Labor.
2- Labor Minister: The Social Affairs and Labor Minister.
3- The Worker: Any male or female who performs a manual or mental work for an employer under the employer’s management and administration against compensation.
4- The Employer: Natural or legal one that uses the services of workers against compensation.
5- corporation: A corporation workers or employers with same or affiliated businesses, occupations or guards their interests, oppose their rights and represent them in all matters related to their affairs.
Article (2)
The provisions of this Law shall apply to all or any workers within the private sector.
Article (3)
The provisions of this Law shall apply to marine work accept respect of anything not provided for within the Marine mercantile law or within the event where the text of this Law is more beneficial to the worker.
Article (4)
The provisions of this Law shall apply to the oil sector in respect of anything not provided for within the Law of Labor within the Oil Sector or within the event where this Law is more favorable to the worker.
Article (5)
The following shall be excluded from the appliance of this Law:
Workers who are subject to other laws and to the provisions of these laws: Domestic workers: the competent minister shall issue a resolution concerning their affairs setting forth the principles that organize their relations with the employers.
Article (6)
unfairness to any more favorable benefits and rights allowed to workers in personal or mutual contracts, special regulations or by-laws observed by the employer or in accordance with professional or general rules, the rules of this Law shall indicate the normal level of workers’ rights.
